Welcome to Derich Gallery.
These Terms of Service (“Terms”) govern your use of derichgallery.com, your purchases from Derich Gallery, and your interactions with our services.
By accessing our website, placing an order, or otherwise using our services, you agree to these Terms, together with our Returns & Guarantee Policy and Privacy Policy.
Please read them carefully before making a purchase.
1. Who We Are
Derich Gallery is an independent art business based in Charlotte, North Carolina, USA.
We create and sell handcrafted three-dimensional artwork and shadow box pieces incorporating real physical objects, decorative elements, currency-related materials, replica objects, and other artistic components.
Our products are intended for artistic and decorative display purposes.

2. Eligibility & Lawful Use
By using our website or purchasing from us, you represent that you are:
- at least 18 years old or the legal age required to enter into a binding agreement in your jurisdiction;
- legally permitted to purchase the products you order;
- using our website and services for lawful purposes.
You are responsible for complying with applicable local, state, federal, and international laws relating to the purchase, possession, display, transportation, and import of the products you order.
3. Handmade Artwork & Product Characteristics
Derich Gallery products are handcrafted physical artworks.
Because many pieces are assembled by hand and may include real three-dimensional objects, minor variations may naturally occur between individual pieces.
Such variations may include small differences in:
- positioning;
- alignment;
- texture;
- finish;
- materials;
- natural characteristics of physical objects;
- other minor handmade details.
Reasonable handmade variations are not considered defects.
We make reasonable efforts to present our products accurately. However, colors, reflections, scale, texture, and appearance may vary slightly depending on photography, lighting, screen settings, device displays, and the handmade nature of the artwork.
4. Decorative & Replica Objects
Some artworks may contain replica objects, currency, currency-inspired elements, or other materials that may be subject to laws or restrictions in certain locations.
Any replica objects included in our artwork are intended solely as decorative artistic elements and are not sold or represented as functional weapons.
It is the customer’s responsibility to determine whether a particular artwork may legally be purchased, possessed, displayed, shipped, or imported in their location.
Derich Gallery does not guarantee that every product can legally be imported into every country, state, province, or jurisdiction.
5. Orders, Availability & Acceptance
Submitting an order does not automatically guarantee acceptance.
All orders are subject to:
- product availability;
- successful payment authorization;
- fraud and security screening;
- shipping availability;
- applicable legal restrictions;
- our acceptance of the order.
We reserve the right, where reasonably necessary, to refuse, cancel, limit, or request additional verification for an order.
This may include situations involving:
- suspected fraud;
- unauthorized transactions;
- payment problems;
- incorrect or incomplete information;
- unusual purchasing activity;
- inventory limitations;
- shipping restrictions;
- suspected policy abuse;
- previous fraudulent claims or chargeback activity;
- legal or regulatory concerns.
If we cancel an order after payment has been successfully collected and no amount is otherwise owed, the applicable payment will be refunded.
6. Prices, Payments & Taxes
Unless otherwise stated, prices on our website are displayed in U.S. dollars (USD).
Payments may be processed through third-party payment providers such as:
- Shopify Payments;
- Shop Pay;
- PayPal;
- Apple Pay;
- Google Pay;
- credit or debit card networks;
- other payment options made available at checkout.
We generally do not directly receive or store your complete credit or debit card number.
Applicable sales taxes, duties, customs charges, or other governmental charges may be added or collected depending on the order and destination.
We reserve the right to correct pricing, product-description, or technical errors before accepting or fulfilling an order.
7. Shipping & Delivery
Shipping methods, estimated delivery times, and available rates may vary depending on the product, destination, size, and carrier.
Processing and delivery estimates are estimates only and are not guaranteed delivery dates.
Delays may occur because of:
- carrier operations;
- weather;
- holidays;
- incorrect addresses;
- customs;
- security inspections;
- natural events;
- transportation disruptions;
- other circumstances outside our reasonable control.
We will provide available tracking information when applicable.
Customers are responsible for providing a complete and accurate shipping address.
Additional costs caused by an incorrect or incomplete address supplied by the customer may be the customer’s responsibility where permitted by law.
8. Packages Marked “Delivered” but Not Received
If carrier tracking shows that your package was Delivered, but you cannot locate it, please contact the carrier as soon as possible.
We recommend checking:
- the delivery location;
- other members of your household;
- neighbors;
- front desk, reception, concierge, or building management;
- alternate delivery locations indicated by the carrier.
The carrier may have additional information such as:
- delivery photographs;
- GPS or location information;
- delivery scans;
- driver notes;
- other delivery records.

We will provide reasonably available tracking information, shipment documentation, and assistance with the carrier investigation.
However, when carrier records indicate successful delivery to the shipping address provided at checkout, a refund or replacement is not automatically issued solely because the package cannot later be located.
We may require a carrier investigation before determining the appropriate resolution.
Each situation may be reviewed individually based on tracking records, carrier findings, delivery evidence, communications, and other relevant information.
If the carrier confirms that the shipment was lost, misdelivered, or otherwise not properly delivered, we will review the circumstances and determine an appropriate next step.
9. Damaged, Defective or Incorrect Artwork
If artwork arrives damaged, broken, defective, or incorrect, please contact us as soon as possible.
We may request:
- your order number;
- photographs of the artwork;
- photographs of the damaged area;
- photographs of the packaging;
- other information reasonably necessary to verify the issue.
Once the issue is reviewed and confirmed, we will arrange an appropriate resolution at no additional cost to the customer for a confirmed issue that occurred before or during delivery or resulted from our error.
Depending on the circumstances, this may include:
- replacement;
- repair;
- correction;
- refund;
- another reasonable resolution.
If a return is necessary, we will provide instructions and, when applicable, an appropriate return method or prepaid return label.
10. Returns & Refunds
Our Returns & Guarantee Policy contains the full terms governing returns and refunds and is incorporated into these Terms.
Standard Non-Custom Artwork
Standard, non-custom artwork may be returned within 30 days of delivery, regardless of the reason, subject to the conditions in our Returns & Guarantee Policy.
Standard Artwork Priced at $900 or More
If a standard artwork priced at $900 or more is returned solely because the customer changed their mind or no longer wants the artwork:
- the customer is responsible for the original shipping cost;
- the customer is responsible for return shipping.
If the original order included Free Shipping, the actual shipping cost paid by Derich Gallery to deliver the artwork may be deducted from the refund.
If shipping was separately paid at checkout, the original shipping charge is non-refundable.
These special shipping-cost rules apply only to eligible change-of-mind returns of standard artworks priced at $900 or more.
Custom, Personalized & Commissioned Artwork
Custom, personalized, and commissioned artworks are Final Sale for change-of-mind or preference-based returns.
These works are created specifically for an individual customer and may not be suitable for resale to another collector.
Custom orders remain protected if they:
- arrive damaged;
- contain a genuine defect;
- are incorrect because of our error;
- are materially different from the approved order specifications.
In those situations, we will review the issue and determine an appropriate replacement, correction, repair, refund where appropriate, or other reasonable resolution.
Refund Processing
Approved refunds are generally issued to the original payment method within 5–7 business days after the returned artwork is received and inspected.
Additional processing time may be required by your bank or payment provider.
If any provision of this section conflicts with our current Returns & Guarantee Policy, the Returns & Guarantee Policy will control with respect to returns and refunds.
11. Return Packaging
Artwork returned to Derich Gallery must be securely packaged.
Because our pieces may contain glass and three-dimensional objects, we strongly recommend keeping and reusing the original packaging whenever possible.
If a customer-initiated return is damaged because of improper or insufficient return packaging, this may affect the amount eligible for refund.
Customers may contact us before returning an artwork for packaging recommendations.
12. Order Cancellations
If you wish to cancel an order, contact us as soon as possible at:
If production has not begun and the order has not shipped, we will do our best to cancel it.
If production has already begun or the artwork has shipped, standard non-custom artwork may still qualify for return under our applicable Returns & Guarantee Policy after delivery.
Because custom, personalized, and commissioned pieces are made specifically for the customer, they may no longer be cancellable once production has begun.
13. International Orders & Customs
Customers ordering outside the United States are responsible for determining whether the artwork can legally be imported into their destination country.
Some pieces may contain replica objects, currency, or other physical components subject to customs or import restrictions.
Derich Gallery cannot guarantee customs clearance in another country.
Customers are responsible for applicable:
- import requirements;
- customs duties;
- taxes;
- brokerage fees;
- permits;
- other import-related charges or requirements.
If an international shipment is rejected by customs and returned to us, the eligible product price may be refunded after the artwork has been returned and inspected.
Unless otherwise required by applicable law, the following are non-refundable:
- original shipping charges;
- return shipping charges;
- customs fees;
- duties;
- taxes;
- brokerage costs;
- other import-related expenses.
Derich Gallery is not responsible for losses caused by a customer’s failure to comply with applicable import laws or restrictions.
14. Packaging
Our artwork comes in different sizes, weights, materials, and constructions.
For that reason, packaging methods and materials vary by shipment.
Depending on the artwork, packaging may include different combinations of:
- protective wrapping;
- cushioning;
- foam;
- corner protection;
- rigid reinforcement;
- shipping boxes;
- additional protective materials.
Larger or heavier pieces may require additional reinforcement.
We select packaging based on the size, construction, weight, and shipping requirements of the artwork.
15. Intellectual Property
Unless otherwise stated, the Derich Gallery website and its original content are owned by or licensed to Derich Gallery.
This may include:
- photographs;
- videos;
- logos;
- branding;
- website graphics;
- written content;
- artwork designs;
- product presentation;
- promotional materials.
You may not reproduce, copy, publish, commercially exploit, distribute, modify, or use our protected content without permission where such permission is legally required.
Purchasing a physical artwork does not transfer copyright or other intellectual-property rights in the artwork design, photography, branding, or related creative materials unless expressly agreed in writing.
Nothing in these Terms is intended to restrict lawful ownership or lawful resale rights that cannot legally be restricted.
16. Prohibited Use
You may not use our website or services to:
- engage in unlawful activity;
- commit fraud;
- submit knowingly false claims;
- interfere with the security or operation of the website;
- attempt unauthorized access to systems or accounts;
- misuse payment or chargeback systems;
- infringe intellectual-property rights;
- submit malicious code;
- impersonate another person;
- violate applicable laws or regulations.
We reserve the right to restrict access, cancel orders, preserve relevant evidence, or take other lawful action when reasonably necessary to protect our customers, business, systems, or legal rights.
17. Fraud, Claims & Chargebacks
We may retain and use relevant order records, communications, payment information, tracking records, delivery evidence, photographs, device or technical information, and other available records to investigate:
- suspected fraud;
- unauthorized transactions;
- false delivery claims;
- fraudulent return claims;
- payment disputes;
- chargebacks;
- violations of our policies.
Where legally permitted, we may provide relevant records to payment processors, financial institutions, shipping carriers, insurers, fraud-prevention providers, courts, regulators, law enforcement, or professional advisers when reasonably necessary to resolve a dispute or protect legal rights.
Nothing in this section prevents a customer from exercising legitimate rights available under applicable law or through their payment provider.
18. Disclaimer & Limitation of Liability
To the fullest extent permitted by applicable law, Derich Gallery will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of our website or products.
This may include loss of profits, business interruption, or other indirect losses.
Derich Gallery is not responsible for delays or failures caused by circumstances outside our reasonable control, including carrier delays, customs actions, weather, transportation disruptions, network failures, natural disasters, governmental actions, or other similar events.
To the fullest extent permitted by applicable law, our aggregate liability relating to a particular order will not exceed the amount actually paid to Derich Gallery for the product giving rise to the claim.
Nothing in these Terms excludes or limits any consumer right or liability that cannot legally be excluded or limited.
19. Third-Party Services
Our website may interact with third-party providers, including payment processors, shipping carriers, Shopify, social-media platforms, advertising services, and other technology providers.
We do not control independent third-party services or their separate terms, availability, security, or privacy practices.
Your direct use of those services may also be governed by their own terms and policies.
20. Privacy
Our collection, use, disclosure, and processing of personal information are governed by our Privacy Policy.
The Privacy Policy forms part of the overall terms governing your interaction with Derich Gallery.
If a privacy-related provision in these Terms conflicts with the current Privacy Policy, the Privacy Policy will control with respect to personal-information practices.
21. Governing Law & Disputes
If a concern arises, we encourage you to contact us first at:
We will make a reasonable effort to resolve legitimate concerns directly.
To the extent permitted by applicable law, these Terms and disputes involving Derich Gallery will be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
Where legally enforceable, disputes that cannot be resolved informally may be brought before the appropriate courts located in or serving Mecklenburg County, North Carolina.
Nothing in this section removes consumer rights or jurisdictional protections that cannot legally be waived.

We may update these Terms periodically to reflect changes in:

- business practices;
- technology;
- legal requirements;
- policies.

Where applicable law requires additional notice or consent for a material change, we will provide it as required.
23. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or separated from the remaining Terms.
The remaining provisions will continue in effect.
24. Entire Agreement
These Terms, together with our applicable Returns & Guarantee Policy, Privacy Policy, and any specific terms clearly disclosed at the time of purchase, constitute the applicable agreement between you and Derich Gallery regarding use of our website and purchases from us.
